After the recent decision of the Supreme Court, Kamil (Bachelor) and Fazil (Post-Graduate) degrees will now be out of the purview of madrasas. This means that these degrees will now be recognized only by universities and not by madrassas. This change is an important step for the Uttar Pradesh government, which will limit the scope of madrassas and give major responsibility to universities for higher education.
Proposed changes in the Madrasa Shiksha Parishad Act-2004
The Government of Uttar Pradesh has decided to amend the Madrasa Shiksha Parishad Act-2004. Under this, Kamil and Fazil degrees will no longer be awarded by madrasas, as they come under higher education. After this amendment, only universities will have the authority to grant higher education and related degrees. The Supreme Court recently upheld the constitutional validity of the Act, while the Allahabad High Court declared it unconstitutional.

The Supreme Court made it clear that from now on Madrasa giving Kamil and Fazil degrees after the twelfth standard will not be recognized. Higher education is governed under the UGC Act, and these degrees can only be recognized by universities.
Purpose of Madrasa Education Council Act-2004
This Act regulates the standard of education in madrasas. Under this Madrasah Board conducts examinations for various courses, such as Munshi, Maulvi, Alim, Kamil and Fazil.
Post-Amendment Scenario
After the amendment, madrasas will be allowed to provide only primary and secondary education, and dependence on universities for higher education will increase.
